Copyright and takedowns
This library is filled partly by the people who use it. If something here is yours and should not be, this is the fastest way to have it removed.
Reporting something
Send a notice to support@plicklistings.com. Include all six of the following, because the law requires them and a notice missing one cannot be acted on:
- Your physical or electronic signature.
- Identification of the work you say was infringed. If there are many, a representative list is enough.
- Identification of the material you want removed, specific enough for it to be found — a direct link to the sample or preset page is ideal.
- Your contact details: address, telephone number and email.
- A statement that you believe in good faith the use is not authorised by you, your agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are the owner or are authorised to act for the owner.
A notice sent in bad faith has costs of its own: someone who knowingly misrepresents that material is infringing can be liable for the damages that misrepresentation causes.
What happens next
Valid notices are acted on expeditiously. The material comes down or is disabled, and whoever uploaded it is told what was removed and why, along with a copy of the notice. Nothing is removed quietly.
Removal is not a finding that anybody did anything wrong. It is what the process requires while the question is open.
Disputing a removal
If your upload was removed and you believe that was a mistake or a misidentification, send a counter-notice to the same address containing:
- Your physical or electronic signature.
- Identification of what was removed and where it appeared before it was removed.
- A statement, under penalty of perjury, that you believe in good faith the material was removed as a result of mistake or misidentification.
- Your name, address and telephone number, your consent to the jurisdiction of a federal court where you live (or, if you are outside the United States, where this site’s operator may be found), and your agreement to accept service of process from the person who sent the notice.
A valid counter-notice is forwarded to whoever complained. Unless they tell us they have gone to court, the material may be restored in ten to fourteen business days.
Repeat infringers
Accounts that attract repeated valid notices are terminated, and the addresses behind them are not welcome back. This is not discretionary: a site that hosts what other people send it has to enforce this to keep the protection the law offers it, and enforcing it is cheaper than the alternative.
Designated agent
Notices should go to the agent designated to receive them:
- Copyright Agent
- support@plicklistings.com
- 3200 McKinney Ave, Dallas, TX 75204, USA
- +1 806-676-3785
Material we published ourselves
Not everything here arrived from a contributor. Part of the library was assembled by the operator from packs and other sources, and those files are published under the vault’s own name rather than a person’s. The takedown process above applies to them exactly the same way, and a notice about one is treated no differently.
If you would rather not send a formal notice, an email describing what is yours is enough to get it looked at.
